New Environmental Rules for NYC Co-ops and Condos

Several new environmental regulations are set to impact multifamily co-op and condo communities in New York City. These include Local Law 157, which pertains to natural gas detectors, and Local Law 88, as amended by Local Laws 132 and 134, which mandates lighting system upgrades and submetering for commercial tenants. The final rules for Local Law 157 were published on February 14, 2024, and the compliance deadline for Local Law 88 is December 31, 2024.

"These rules have been anticipated for some time," says William McCracken, a partner at the NYC-based law firm Morritt Hock & Hamroff, regarding Local Law 157. "The New York City Council passed Local Law 157 in 2016 following the fatal East Village and East Harlem gas explosions. It directed the Department of Buildings (DOB) to create a natural gas detector requirement once an industry standard was developed, which occurred in 2022, leading to the DOB's rule."

"Local Law 88 is somewhat unusual because its main requirements are now common sense and standard practice for well-managed buildings," McCracken adds. "In 2024, it's clear that LED lights are much more efficient than incandescent bulbs and quickly pay for themselves after installation."

Vigilance Required

Co-op and condo boards should not assume compliance merely because they have converted to LED lighting. Associations and corporations must ensure that their entire building’s lighting system adheres to New York City’s Energy Conservation Code. This includes installing compliant interior and exterior lighting, lighting controls, and tandem wiring.

Regarding submetering, associations and corporations must install electrical submeters and provide tenants with regular, accurate energy use readings. This information aims to encourage tenants to reduce their energy consumption.

For Local Law 157, condo and co-op boards should work with their management companies to coordinate compliance with the new rules. Boards should note that there are various types of compliant detectors, some of which, though more expensive, might reduce the risk of false alarms leading to gas shutdowns. McCracken advises his clients to amend house rules and alteration agreements to inform residents about the mandatory installation of natural gas detectors.

Local Law 88 also includes a highly technical requirement: installations must be certified by a registered design professional, licensed master electrician, or special electrician and filed with the Department by January 1, 2025. "Therefore," emphasizes McCracken, "any building that has not yet hired a specialist consultant to oversee the upgrades and certify the work should do so immediately."

ALBUQUERQUE, N.M. – Some of the darkest spots Downtown are getting brighter. It’s a part of a new approach the city thinks should make things safer.

The city said it’s aiming to put up more than 50 new lights all around Downtown.

“We just love it because now, all these people who are going into these businesses, especially after dark can feel that much safer. A lot of the businesses along here use the alley for access, so everything we can do to make those guys feel safer the better,” said Albuquerque Department of Municipal Development Spokesperson Dan Mayfield.

The department said this lighting initiative comes after a proposal by City Councilor Isaac Benton who requested a safer approach. Mayfield said, over the last six months, crews have installed 24 LED lights in the alley between Central and Copper. Those lights run from 3rd Street up to 6th Street.

In addition to that corridor, Mayfield said crews have also installed a total of 18 lights along the Copper corridor and a few others from 3rd Street up towards 6th. People who live and work in the heart of Downtown are welcoming the approach to safety.

The city stated it’s still working to install 12 more LED lights along Copper and Silver, but it expects to finish that project over the next couple of months. Mayfield said the city plans on using federal funding to cover the million-dollar project.

LED lighting is more an IT project than just a traditional lighting retrofit. Just like implementing any IT solution in your company, you need to plan, design, and engineer the project to ensure you are getting a solution that meets your business needs.

With traditional lighting technology, you use a fixture that has some version of a round lamp. Light emits from the lamp at 360 degrees. Manufacturers use reflectors in fixtures to bounce at least half of the light that is going up, in different directions. The issue with using reflectors is that every time you reflect light, the light source gets weaker. By the time the light hits the ground, it could have lost over 75% of its initial output. That’s why traditional lighting fixtures use so much wattage in order to overcompensate for all of the lost light on the way to the ground.

In LED technology, light comes out of the LED diode at only 180 degrees. In order to direct the light, manufacturers use optics. Optics are small lenses that are put on top of each LED Diode that bend, magnify and direct the light to illuminate the right area. Using optics, light can be directed in an endless number of patterns. For a warehouse aisle that is only 10 feet wide, we can engineer a LED fixture to send light in a rectangle pattern so that more light is thrown down the aisle versus across it.

Most vendors and lighting companies try to sell you LED lights to simply replace your current fixtures. It is important to understand that just because you have 50 fixtures, the most efficient solution is not necessarily to replace them with 50 LED fixtures. As an example, a parking lot may currently be fitted with 4, 400 watt metal halide fixtures on multiple poles to adequately cover the entire lot. By using sophisticated lighting software, we can analyze the different optic configurations of an LED fixture and design a solution that provides increased light for the same coverage using only 2 or 3 LED fixtures while using a fraction of the energy.

Since we are using 60-85% less energy for the same amount of light with a new LED system, there may be opportunities to re-engineer the actual lighting circuits. We can reduce some of the electrical loads off of certain circuits and add loads to others. This creates a more balanced system that reduces overall stress resulting in lower energy costs and longer life. This can only be achieved by having an engineer look at the total electrical infrastructure in relation to the new lighting system to determine the optimal configuration.

Unfortunately, most LED products will fail and fail quickly. Does it really matter if there is a warranty when your fixture is 40 feet up in the air? Someone has to get up there and replace it. Your low maintenance product just turned into a high maintenance problem.

The good news is that there are manufacturers who are making great LED products that will save you money and will last a very long time. So how can you tell if a product is made well and will last? The first thing we do is reverse engineer and take apart products to see the components the manufacturer is using, a process we call, “what’s under the hood?” Just like any manufactured product, if the components that are being used to create the product are cheap and not well designed, you will have problems. We look at the following: LED Diodes, Power supplies, Cabinet or outer shells, Wire connections, Thermal boards, and other items. We then look at the manufacturer’s strategy for Thermal Management. If there is no thermal management strategy, we will not recommend the product. We then look at the specifications of the product to see where they fit compared to other quality products that we know about. We look at efficacy, CRI, rated Life, warranty, and other factors.

CRI stands for Color Rendering Index. It is an index that goes up to 100 and measures the quality of light color. It should not be confused with color temperature, which measures the actual color of the light from 2000k(warm yellow-8000k(cold blue). A CRI of 100 has the quality as close to natural sunlight as possible. It is always a goal of good manufactures to create products with a high CRI for the comfort of the user. Most subpar manufacturers hide their CRI rating and have CRI’s of 70 or less.

Efficacy is the amount of lumens (a measurement of light) delivered per watt. A 50w product that claims to have an efficacy of 100 lumens/watt will deliver 5,000 lumens of light. The better manufacturers are investing in R&D and better components to produce products with very high efficacy. Some of the best products are achieving 150 lumens per watt which means you can get the same amount of lumens using less energy. In our example, that means using 33 watts of power to get 5,000 lumens. If you multiply the difference in wattage of the 2 products (17w) times hundreds of light fixtures, you are literally saving thousands of dollars by going with a high efficacy product.

Other factors we look for include, end-user references and case studies, quality of the manufacturer’s executive team, the financial strength of the manufacturer, and we also conduct field visits to the factories to ensure quality processes.

Rated Life – What is Really Means for your LED Lighting

Let’s start by what they mean when they say 100,000 hours. In traditional lighting Rated Life means how long it takes for half the light bulbs in a test batch to fail . That’s right; a 50% failure rate helps prove a product’s rated life. Only in the lighting industry can you get away with stuff like that! With LED lighting they take it a step further. When LED manufacturers claim a certain rated life, they consider failure to be when a product can no longer produce 70% or more of the initial lumen output. They call this the “ L70 ”. So in theory, that is better than just saying the lamp is dead. At least there is still light coming out of it! But because the light is so degraded, the industry considers this a failure .

Now let’s go back to the issue that manufacturers are claiming 100,000 hour life yet the product has only been around for 2-3 years. What they do is something called a LM80 test , which is performed by an EPA accredited lab. A LM80 test is a standard that specifies test conditions and methods of measurement for determining the useful life span of an LED package, array or module. Here is how it works.

The test requires a minimum of 6,000 hours of observation with performance data collected every 1,000 hours and documented. The LM80 test stops at 6000 hours. The LM80 test is performed at 3 different test temperatures-55°C, 85°C, and one at the manufacturer’s choice.

So how do they get to 100,000? That’s where the TM21 worksheet comes in. The TM-21 provides a projection of the lumen maintenance of an LED source (package/array/module) based on data collected according to LM-80. The actual formula they use is: Φ (t) = B exp(-αt) . We are not going to get into the details of the formula here, but basically the rated life is an educated forecast.

Hopefully you are still with me. Here is the secret about LM80 and TM21’s. Because manufactures perform the LM80 test at 3 temperatures (2 of which are mandatory by the lab and one of those temperatures is their choice), MOST manufactures report what their rated life is based on the results of the test from the LOWEST temperature that they chose. This of course yields a stated rated life that shows the longest possible life . Great for sales, bad for the customer! If the product doesn’t have a good thermal management design, you can almost guarantee the product won’t last as long as the stated rated life. If they would disclose the higher temperature results you would find that the stated rated life would be up to 50% less!!! This is why thermal management is critical to making your choice of products.

When we evaluate products for our customers, we ask for all three test results in the LM80 report and the TM21 worksheet for all 3. We then look at how the fixture achieves thermal management. Based on this and other criteria, we make recommendations to our customers.

Thermal Management is the ability to control the temperature of a system technology based on thermodynamics and heat transfer. This is the most critical component in a lighting LED product. While most people think that heat doesn’t matter with LED products (because they have touched an LED light bulb and realized it doesn’t get hot), nothing can be further from the truth. Heat is the biggest enemy with LED systems.

Traditional lighting thrives in heat. From halogen to incandescent to metal halide, these technologies do better when they are hotter. LED is the opposite. If an LED product gets too hot, the LED diode (the small yellow dot you see on LED products where light comes out of, will die.

So how do you deal with heat when designing your LED solution?

Heat Sink

Usually, there is some type of heat sink (a device or substance for absorbing excessive or unwanted heat) that is made out of aluminum. The concept is that the heat sink will transfer some of the heat away from the LED diodes and into the air.

One thing we look for is a heat sink that is extruded vs. die cast. Extrusion is a process used to create objects of a fixed cross-sectional profile. A material is pushed or pulled through a die of the desired cross-section. Die Cast is formed by pouring molten metal into a reusable mold. Extruded Aluminum provides 20-30% greater thermal conductivity than die cast aluminum. Wow big difference, right? Why wouldn’t all manufacturers extrude their aluminum? Quite simply, it costs more to manufacture. The better products use extruded aluminum.

Anodizing is an electrolytic passivation process used to increase the thickness of the natural oxide layer on the surface of metal parts. Powder coating is the process of covering an object with a polyester or epoxy powder, which is then heated to fuse into a protective layer. Anodizing the heat sink yields 100X greater thermal conductivity than powder coating! That’s right, 100 times. So why do most manufacturers powder coat their heat sinks? You guessed it, money. It cost much more money to anodize vs. powder coat.

It’s pretty easy to imagine that the larger the heat sink the more the ability to transfer heat away from the LED source. The best manufacturers will use heat sinks that are significantly larger than their competitors.

The actual geometry of a heat sink is also important. Each heat sink fin needs to have a thinning cross-section because hot seeks cold and heat energy strives to exchange. More air = cooler.

As you can see, all heat sinks are not created equal.

Ventilation

If you have a good heat sink and the heat is being transferred away from the LED source, what needs to happen next? Ideally, there would be a way for heat to completely escape the fixture through ventilation. It is amazing that most manufacturers seal their fixtures airtight. There is literally no way for heat to escape completely. They do this because it is cheaper to manufacture. Even though there are ways of waterproofing a fixture and have proper ventilation, they cost more! A good manufacturer will have air slot ventilation cut into the aluminum cabinet of the fixture to allow air to come and go freely.

Power Supply

Another big source of heat is the power supply. Most manufactures put the power supply on top of the heat sink in order to keep the fixture small and compact. By doing this ensures that all the heat coming from the heat sink will transfer directly to the power supply. Power supply failures are the #1 cause of LED fixtures going dark. A good manufacturer will put the power supply next to the heat sink and they will raise it off of the shell so air can flow around on all 6 sides.

Spacing of LED’s

Finally, the spacing of the LED Diodes is very important. Since so much power is coming into the LED and the result is 30% light/ 70% heat (by the way, a traditional bulb has 5% light to 95% heat), in an ideal world a manufacturer would space out the LED Diodes on the board so there are more thermal pathways for heat to escape . If you put lots of LED diodes clustered together, you are creating a massive amount of heat in a small area. Not good for longevity!

Thermal management is such an important aspect of LED lighting that you must know what to look for and how to compare products. Most projects get approved based on a Simple Payback Period (SPP). The SPP is calculated on the total cost of the project divided by the annual energy savings the project produces. Sometimes maintenance costs are included in this calculation since the theory is that after doing a LED retrofit, you will no longer have to replace lamps and ballasts. So if a project costs $100,000 and the annual savings is $50,000 ($40,000 in energy/$10,000 in maintenance) the simple payback would be two years.

What if I told you that the energy savings calculated are actually the smallest amount of savings your business will see based on doing the LED retrofit? Let me explain. Let’s take the example of a manufacturer of metal products. They currently have Metal Halide and T12 Fluorescent fixtures all over the plant. There are lots of fixtures that have failed and are producing no light. The overall lighting quality of the plant is poor and the company spends a lot of money and time on maintaining the lights.

By replacing the lights with the proper LED solution, it is obvious that this company will save a lot of money on energy and maintenance. But, the savings from those items pales in comparison to the overall non-utility-cost financial savings that will be produced by doing this project. Let’s talk about the real issues that having poor lighting is causing:

Employee Turnover: Employees hate bad lighting. It makes their job harder and they don’t feel good when it’s dim and dreary. Imagine working an 8+ hour shift with dim, buzzing and blinking lights above you. Do you think that employees are going to do their best work? Will they perform at peak efficiency? With good employees having their pick of jobs these days, how long will they tolerate a poor working environment? The result of consistently poor lighting is higher employee turnover, more sick days, and less productive shifts. Now, let’s take the same company that invests in new efficient LED lighting. How much does high turnover cost your company? If you could reduce turnover by even 10%, what is the real cost savings on that? I bet its higher than the energy savings.

Defects and errors: When people can see properly, they produce fewer errors and defective products. Less scrap and waste products are also produced. If you can cut down the amount of defective products produced by 1-5%, how much will that save your business per year? Once again, I bet it’s more than the energy savings.

Higher productivity: If you can produce 500 units in a month with bad lighting, what can you produce with good lighting? If the people on your line can see better, they can move faster, will make fewer mistakes, and can spot defects quicker. If someone is trying to pick a product out of a rack, do you think they can pick that product quicker if they can see better? Of course they can. They will also make fewer mistakes and won’t damage other goods. What would an increase of 1-5% in your productivity mean for your organization? How much extra money would you make? Again, I bet it’s more than the energy savings.

There are numerous other examples of non-utility-cost financial savings when converting from old lighting to LED. If you factor in the total employee efficiency savings generated by going to LED, not just the utility and maintenance savings, your simple payback would go from two years to probably months. It may even be weeks. With LED lighting, the energy savings is just the tip of the iceberg.

Top 10 Mistakes to Avoid with a Commercial/Industrial LED Conversion (PART TWO)

Continuing from our May article , below are the remaining 5 mistakes to avoid!

5. Using too high of a color temperature for your outdoor parking lot lights. We get requests all the time from customers that want the highest temperature you can get so the parking lot appears brighter. We hear this from car dealers to shopping mall owners. While we don’t mind going up to 5000k in outdoor, we highly recommend that you do not go over that color. We see car dealer lots with 6000k or even higher. You will notice this if you ever pass a car dealer and notice how bright the lot is BUT also notice how WHITE the lot is. All the color gets whitewashed and instead of having the bright red sports car stand out, it looks like a very odd color that has no pop. For shopping center owners you have to remind yourself who the parking lot is for. Your customers are coming out of their homes which have warm low-temperature light (2700k), they travel on the main roads which usually have even lower temperature light (2200k) and then they arrive at your lot. If you have a 5700k color in your lot, it doesn’t feel natural to your customer. It feels stark, cold, and uninviting. If you are relying on creating a first impression for a customer, you want them to think your lot is comfortable, bright and inviting. 4000k is plenty for this feeling.

4. Making your decision solely on the breakeven. We hear this all the time. As long as the breakeven is 1.5 years or less, we can get this project approved. The problem with this theory is that a lot of companies know this is a requirement and they will sell you sub-par, cheap fixtures just to meet this requirement. So while you may break even at 1.5 years, you wind up having constant light failures, warranty replacements, and degraded light levels. The cheaper fixtures only last 1 to 5 years and then you have to reinstall again. Ask the owner if he would rather have a 1.5-year payback that he will have to re-install in 3 to 5 years versus a 2-year payback that will last 10 years.

3. Confusing CCT with CRI. Color temperature defines the color appearance of a white LED. CCT is defined in degrees Kelvin; a warm light (orange/yellow) is around 2700K or less, moving to neutral white at around 4000K, and to cool white, at 5000K or more. As you get past 5000k, the light looks very blue. CRI (color rendering index) is a measure of how accurately a light source illuminates objects’ true colors. CRI values of a perfect 100 indicate LED lights that are able to produce white light that approximates halogen or incandescent lighting and natural daylight. As you can imagine, the higher the better.

2. Not understanding what the rated life calculation is. The rated life calculation that is printed on the spec sheet is usually BS. Did you know that a rated life calculation is an estimate based on a 6,000-hour sample? The lab doing the testing uses two standard temperatures and then the manufacturer picks a temperature to test. As you can imagine the manufacturer uses a low temperature so they can show the best results. So the number you see on the spec sheet is an estimate of how long a fixture will last based on the coldest temperature possible. When we evaluate new fixtures, we ask for the full testing data so I can see the difference between the coolest temperature and the hottest temperature. Knowing that most LEDs fail due to high temperatures, if the delta between the two tests is too high, we won’t even touch the fixture.

And the #1 mistake to avoid when doing an LED conversion is…

1. Not working with an experienced lighting company. These days, everyone tries to sell LED lighting because they think they can make a quick buck. Most of these companies get in and out of the business very quickly. Since they do not have any real education in lighting, they sell you products that are good for them and NOT for you. One quick way to check if the company you are working with has any real expertise is to ask if anyone on staff has a Lighting Certified (LC) or similar certification.

Converting your facility to LED is hard enough to do one time. Imagine doing a re-install because of massive failures? If you avoid the mistakes above, you can enjoy a new lighting system that will save you money, increase the light levels, create more uniformity on your lighting and will be hassle-free for the next 10+ years! That’s a good deal!!
